If we don’t stand in the way, we can help native youth

Chronic disparities in funding for health, education and social services for more than 700,000 first nations people are the product of entrenched discriminatory policies. But the discriminatory thrust of such policies can be challenged now, under the Human Rights Act… Disparities in essential services to first nations people are well documented… As of June 18, people can file complaints against first nations governments as well as the federal government if they believe they have been discriminated against in relation to services that affect their daily lives.

Ontario publishes accessibility standards

The Ontario government has released the final Integrated Accessibility Standards Regulation under the Accessibility for Ontarians with Disabilities Act, 2005. The regulation, which comes into force on July 1, 2011, combines information and communication, employment, and transportation standards… the regulation “represents a significant shift in human rights and accessibility law affecting nearly all organizations in Ontario with respect to their human resources practices and in the way they do business.”

For more diversity in the legal profession

A more racially diverse legal profession and judiciary is a goal worth pursuing. It is important to have legal leaders who reflect Canada’s rapidly changing demographics. This would help law firms to compete successfully in the global economy and foster innovation, and help judges and Crown prosecutors overcome any subconscious biases, so that they can apply the law more equitably. So far, the record is mixed.

Sponsors of ‘rogue’ immigrants must repay welfare, Supreme Court rules

The Supreme Court of Canada has upheld the right of federal and provincial governments to collect social-service payments from the sponsors of immigrants. The landmark ruling involves the cases of eight Ontario immigrant families that sponsored relatives from abroad, and who later went on social assistance. Under federal immigration law, the sponsors agreed to repay any welfare payments that their new arrivals may have incurred after they got to Canada.

The high price of being a trailblazer

Thousands of students with disabilities have to miss classes, drop courses and extend their years of university, taking on more debt than their nondisabled peers. In 2007, she launched a constitutional challenge, alleging that the Canada Student Loan Program violates the equality clause in the Charter of Rights… Simpson can’t afford to keep fighting… She earns a modest salary as a counsellor at the Canadian Hearing Society. But she refuses to buckle. This is no longer about her. It’s about all the young people with disabilities who are counting on her to be their trailblazer.

Yes, we must pay attention to judges’ values

Merit has often been interpreted to mean that judges should follow the law, not make it. Few today in the Charter age maintain such a stark and unrealistic stance… when we select judges, we should pay attention to their values, not try to ignore them. Pretending to do otherwise is not only a mistake but also a fraud on democracy and the Canadian people. If adjudication is about values and ideals, then we owe it to ourselves to inquire into the values and ideals of those who are or about to be judges.

Wait lists for special education double for low-income students

“The average number of children on special education waiting lists in high poverty schools (10) is more than double the average number of children (4) per low poverty school,” says the study by People for Education, a research and advocacy group that for the first time compared special education services and school demographics. “And 28 per cent of high poverty schools report they have identified students who are not receiving the recommended support, again, double the percentage of low poverty schools.”

Justice tempered with compassion

On April 29… the Federal Court of Appeal ruled that Ottawa cannot reject an immigration application from an individual who is too poor to pay its $550 processing fee. “The Minister is obliged to consider a request for an exemption from the requirement,” the court said in a unanimous judgment… To immigrant groups, it is a legal breakthrough. To critics of the court, it is a retrogressive judgment that will drive up costs and unleash a flood of applications from illegal immigrants… Federal bureaucrats will no longer be able to deport would-be immigrants because they can’t afford Ottawa’s steep application fees

Millionaire nation: Canada tops G7 rich list

the sustained housing boom and surging Canadian dollar have produced some very lofty housing prices relative to much of the developed world. This divide is especially stark when considering the U.S. real estate implosion following the subprime crisis… While there is a greater proportion of millionaires in Canada than any other major economy, the average millionaire household has assets of about US$1.9-million. This is pretty middle-of-the-pack compared with the United States at US$3.7-million and Switzerland, which tops the list of all counties with US$4.2-million per millionaire household.

First Nations Children: The back of the bus

Canada’s failure to address the growing gap in education funding for on-reserve schools will hold every Canadian back. It defies imagination how the human argument — the calls for social justice or children’s rights — continues to fall on deaf ears and fails to elicit a human response from those who seek to lead this country… The funding formula for First Nations education has not been revised in 22 years; it has not kept pace with costs in 13 years. Now that we are in the midst of a federal election campaign, it is time for all political parties to commit to an equitable approach to education funding.
